What is an authorised agent?
Typically a surveyor, architect or solicitor with written authority from the building owner to serve notices on their behalf.

Building Owner(s)

The person carrying out notifiable works under the Party Wall Act.

Who counts as an owner?
Anyone holding freehold or leasehold title for more than one year, or under contract to purchase. Check Land Registry if unsure. Include all joint owners.

Adjoining Owner(s)

The owner of the neighbouring property affected by the works. Generate a separate notice for each adjoining owner.

Section 1 — New wall at the line of junction

Building a new wall where two properties meet. If you're not building a new wall at the boundary, select No to all.

When does Section 1 apply?
Section 1 covers building a new wall at the boundary. Section 1(2) straddles both lands (needs consent). Section 1(5) is wholly on your land. Section 1(6) covers projecting foundations.

Section 2 — Works to an existing party wall

Work to a wall or structure already on the boundary — e.g. inserting a steel beam, underpinning, raising the wall.

Section 6 — Excavation near adjacent buildings

Excavating near a neighbour's building — e.g. for foundations or a basement.

When does Section 6 apply?
S.6(1) — within 3m and deeper than their foundations. S.6(2) — within 6m where a 45° line from their foundations would meet your dig. Plans must accompany the notice.

Reinforced concrete foundations (e.g. piled foundations, reinforced rafts). If placed on the adjoining owner's land, their written consent is needed.

Surveyor's details

If an adjoining owner is served notice and dissents to the proposed work, an 'actual dispute' exists. If they do not positively consent to works under section 2 or section 6 within 14 days of service, they are deemed to have dissented and a 'deemed dispute' is considered to exist.

Any 'actual' dispute or 'deemed' dispute must be settled by party wall surveyors appointed by the two owners. In that case, both owners must either concur in the appointment of a single 'agreed' surveyor, or each must appoint their own surveyor.

The appointed surveyor(s) must then settle the dispute by serving an award (sometimes called a 'party wall agreement'), which sets out the details and particulars of the authorised work.

Looking for Free Party Wall Notice Templates?

You’ve found them. But here’s the thing — the Party Wall etc Act 1996 requires three different types of notices depending on your intended works:

  • Line of Junction Notice — for creating a party wall on or astride the boundary
  • Party Structure Notice — for work to existing shared walls (common in terrace properties)
  • Notice of Adjacent Excavation — for digging within 3-6 metres of your adjoining property’s foundation

Using the wrong notice invalidates the entire process. You’d need to start again, delaying your project by weeks.

What is a Party Wall Notice?

A wall notice is a legal document that informs your neighbour about planned works on your property affecting a shared wall, boundary, or nearby excavation.

It’s not a request for permission. Your adjoining neighbour can’t stop you doing the work (assuming you’ve got planning permission). The notice simply triggers their right to agree to the appointment of a surveyor if they have concerns.

Think of it as official acknowledgement that gives them protection under the provisions of the Act.

What Must a Notice Include?

Every compliant notice must contain:

  • Your name and address (the building owner)
  • Your neighbour’s details (the adjoining owner)
  • Clear description of the intended works
  • Proposed start date (minimum 1-2 months depending on notice type)
  • Statement of rights under the Party Wall etc Act 1996

When to Use a Party Wall Notice

You’re required under the Act to serve party wall notices before:

Building on the Boundary

  • Constructing a new wall on the boundary line
  • Creating a party wall astride the boundary
  • Building up to the boundary against your neighbour’s wall

Use the Line of Junction Notice.

Work to Existing Party Walls

  • Cutting into a party wall to insert beam ends (typical for extensions)
  • Raising a party wall (common in terrace loft conversions)
  • Underpinning or exposing a party wall
  • Party wall surveying work for structural alterations

Use the Party Structure Notice.

Excavation Near the Boundary

  • Digging within 3 metres of your adjoining property, going deeper than their foundation
  • Work near their building within 6 metres if excavation crosses below foundation level

Use the Notice of Adjacent Excavation.

Don’t guess. Get it wrong and you’re looking at injunctions and project delays.

How to Serve Your Party Wall Notice

Serving the notice correctly is crucial for compliance with the Act.

Step 1: Complete the Correct Template

Download the appropriate template above. Fill in all fields with attention to detail — incomplete notices aren’t valid.

Print two copies — one for your neighbour, one for your records.

Step 2: Deliver Properly

Serve by hand delivery, post, or recorded delivery. Always obtain proof of postage if posting.

Email doesn’t count unless your neighbour agrees to electronic notices in writing.

Step 3: Record the Serving Date

Write down when you served it. This starts the 14-day response clock.

Step 4: Wait for Response

Your neighbour has three options:

1. Consent in Writing They’re willing to agree to the works. Party wall agreements can proceed once your notice period expires.

2. Dissent or No Response If they refuse or don’t respond within 14 days, it’s treated as dissent. This triggers surveyor appointments.

3. Counter-Notice (Boundary Walls Only) They may request to build on their side too.

What if a Dispute Arises?

Once dissent occurs, both sides must agree to the appointment of surveyors. You can appoint one agreed surveyor or separate surveyors who then appoint a third to resolve any dispute between us.

The surveyors produce a Party Wall Award — an enforceable legal document setting out how to ensure that the work complies with the Party Wall etc Act 1996.
