The Party Wall Process

Understanding the party wall process before you start carrying out building work saves a significant amount of time and stress. Here's how it works.

You serve a party wall notice on your adjoining owner at least two months before work starts for works to a party wall, or one month for excavation notices. Your neighbour then has 14 days to respond. They can provide their consent in writing, which means no surveyor is needed and you can proceed. They can dissent, which means both parties need to appoint a surveyor. Or they can do nothing, in which case they're deemed to have dissented after 14 days.

Where a surveyor is needed, a party wall award is prepared. This is a legally binding document setting out the scope of works, working hours, access arrangements, and what happens if damage occurs. Once the award is served, building work can begin. The whole process typically takes four to six weeks from notice to award.

Carrying Out Building Work

If you’re carrying out building work that falls under the Act, you’re the building owner. You’re responsible for serving the correct notices before work starts. How much should a party wall surveyor cost?

Costs vary depending on the complexity of the works and whether one surveyor or two are involved. For straightforward projects with a single award, fees typically range from £700 to £1,500. More complex cases involving basements, multiple neighbouring property owners, or resolving disputes will cost more. We work on fixed fees so you know exactly what you’re paying from the outset.

Who pays for a surveyor in a party wall dispute?

In most cases the building owner pays for both surveyors. This includes the cost of the adjoining owner’s surveyor if they appoint their own surveyor. The exception is where an adjoining owner is found to have acted unreasonably, in which case costs can be apportioned differently in the award.

What is the 3 Metre rule for party wall?

The three metre rule means that if you work within 3m of a neighbouring structure and your excavations go deeper than their existing foundations, you must serve a notice under the Act. A six metre rule also applies where excavations are within six metres of a neighbouring structure and would cut a line drawn at 45 degrees downward from the base of their foundations.
