Loft Extension Enclosure
Most loft conversions involve cutting into the shared wall to insert steel beams at roof level, triggering Section 2 of the Party Wall etc. Act 1996. Exposing a party wall or party parapet wall as part of loft works, or exposing the party wall to the weather, requires a formal party wall notice to be served. The wall’s construction and any subsequent use subsequently made by the adjoining owner must be properly documented. A Schedule of Condition is strongly recommended to protect against false claims relating to shared chimney stacks and ceiling structures.
Extension Enclosure
Single and two storey rear extensions and ground floor extension enclosures commonly trigger both Section 2 (works to the party wall) and Section 6 (excavation within 3 metres of a neighbouring building). A flank wall built astride the boundary line or an extension astride the boundary line will require a party wall notice under Section 1 of the Act. The expense of the building owner in carrying out that work can be significant. Where subsequent use is made of the wall’s construction by the adjoining owner, the adjoining owner shall pay a due proportion of the expenses incurred.

How much should a party wall surveyor cost?
Costs vary depending on the complexity of the works and whether one surveyor or two are involved. For straightforward projects with a single award, fees typically range from £700 to £1,500. More complex cases involving basements, multiple neighbouring property owners, or resolving disputes will cost more. We work on fixed fees so you know exactly what you’re paying from the outset.
Who pays for a surveyor in a party wall dispute?
In most cases the building owner pays for both surveyors. This includes the cost of the adjoining owner’s surveyor if they appoint their own surveyor. The exception is where an adjoining owner is found to have acted unreasonably, in which case costs can be apportioned differently in the award.
What is the 3 Metre rule for party wall?
The three metre rule means that if you work within 3m of a neighbouring structure and your excavations go deeper than their existing foundations, you must serve a notice under the Act. A six metre rule also applies where excavations are within six metres of a neighbouring structure and would cut a line drawn at 45 degrees downward from the base of their foundations.
Who needs to appoint a party wall surveyor and what is the reason for doing so?
If you’re the building owner carrying out notifiable works and your neighbour dissents or doesn’t respond to the notice, both parties need to appoint their own surveyor or agree on one surveyor between them. Property surveyors then work together to produce the award that allows the works to proceed legally.
Do I need a surveyor for a party wall agreement?
If your neighbour provides their consent in writing after receiving the notice, no surveyor is needed at all. You simply keep their written consent on file and proceed. A surveyor only becomes necessary if your neighbour dissents, fails to respond within the 14-day window, or if disputes arise that need to be resolved formally.
